The Food Safety and Standards Authority of India (FSSAI) has issued an order on the procedure for reactivation of auto-rejected FSSAI Licensing/ Registration Applications. This order was issued on December 4, 2023 and will be effective from that date.

As per the order, this facility will be available to those FBOs (Food Business Operators) whose applications were auto-rejected because they did not respond to the queries of the authorities within the stipulated time.

In order to avail this facility, the FBO shall fulfill the following conditions:

  1. The facility can be utilised only once for any filed application for new licence/ registration or modification of licence/ registration,
  2. The FBO must avail this facility within 30 days of auto-rejection of the application. The facility can be availed without any intervention of the authority or payment of any fee. However, the FBO must provide a valid reason for the delay in response,
  3. From the 31st to the 60th day after auto-rejection, the FBO can self-reactivate the application without any intervention of the authority. However, he will be required to pay a fee and provide a valid reason for the delay in response.
    • The amount of fee payable is as follows:
      • For Registration Application: Rs. 50 + Applicable GST
      • For Licence Application: Rs. 500 + Applicable GST

This procedure will streamline the process of reactivation of auto-rejected applications. It will reduce waiting time for the approval of authorities in handling request for reactivation of auto-rejected applications.

Furthermore, FBOs are permitted to self-reactivate their auto-rejected applications only on the FoSCoS portal. No request for reactivation of auto-rejected applications by any other mode will be entertained by FSSAI.

It is important to note that this facility is not available in those cases where the grant of licence has been rejected on merit by designated officer under the Food Safety and Standards Act, 2006. In these cases appeal against such orders shall lie to the Commissioner of Food Safety.
